The Federal government was very busy this spring, issuing a flurry of laws that affect dealerships and dealership personnel.
Among them:
- The increased threshold salary of employees who are exempt from overtime because of the administrative, executive, professional exemption and the qualifications for that exemption.
- Dealers must provide reasonable accommodations for a worker’s known limitations related to, affected by, or arising out of pregnancy, childbirth or related medical conditions and examples of those conditions.
- Dealers’ requirement to file a notice with the FTC if a breach occurs of customer information of at least 500 customers.
- FTC bans noncompetes as of Sept. 4, 2024, with all employees, including those senior executive employees.
The key takeaway: Dealers must be proactive with compliance and ensure that employees are trained! Noncompliance can be costly.
